Evaluating degree of guilt of participants to an accident in the Extreme North conditions

The relevance of the study ensues from the problems present in the process of investigation, recording and analysis of industrial accidents, especially in the Extreme North and in neighboring regions. Judicial practice connected with adjudication of disputes on compensation of material and moral damages for casualties and their relatives points at a legal gap to be obligatory clarified and bridged, which is an important trend in the national policy of occupational health and safety toward protection of legitimate interests of employees after accidents. The human errors at work place are analyzed and classified, and the algorithm is proposed to reveal the fact of gross negligence of a worker, with the integral part represented by the deliberate violation of the work flow procedure by a worker. The article presents a case-study of an accident happened with a worker in a hoist in a copper–nickel mine of a Norilsk company. The risk analysis method disclosed the main associate causes of the accident. Using the developed mathematical model, the degree of guilt of the accident participants which violated occupational safety requirements was evaluated. The proposed method defines casuality of an accident and quantitative evaluation of the guilt scale (EGS) for all participants of the accident, which provides a science-based framework for the legal protection of persons accused of violating occupational safety rules.
